Real Estate and Land Use

Our firm handles a wide range of real estate and land use matters, representing parties in mediation, arbitration and litigation. For real estate transactions, we assist buyers and sellers of residential and commercial real estate in all phases of contract negotiation, documentation and interactions with brokers, escrow officers, lenders and title insurance companies. We also perform due diligence property investigations for zoning, construction, geology and engineering issues. Our firm represents both project applicants and project opponents in connection with development projects at both the administrative level and in judicial proceedings.

Our attorneys are also skilled and experienced in assisting property owners in working with local governments to obtain permits and development entitlements, such as coastal development permits, conditional use permits, variances and zone changes. We work with administrative staff and the commissions and councils they serve in order to efficiently process permit applications and resolve issues involving conditions of approval, project revisions and project opposition. We appear on behalf of property owners before administrative agencies and local governments at public hearings on permit matters and, when necessary, seek judicial review of adverse governmental decisions through both traditional and administrative writs of mandate and defend the same when brought by project opponents.

We have extensive experience assisting property owners—whether residential, apartments or homeowners associations—in all manner of property-related disputes, including new construction, construction defect and casualty claims, boundary disputes, nuisance and trespass claims, as well as property claims involving negligence, breach of contract and fraud.

Our attorneys have over thirty years of experience in all facets of real property law, including but not limited to real estate taxation and assessment, common ownership, maintenance, eminent domain, easements, public access, zoning violations, and civil and criminal enforcement actions. While we make every effort to protect our clients from lawsuits and court proceedings, litigation is often necessary and we make every effort to keep the cost of such actions as affordable as possible.

Family Law

At Hirschberg & Friedman, LLP, we provide full-service, attentive, and hands-on counsel in all facets of family law, including but not limited to dissolution, legal separation, guardianship and reproductive matters. Civil Litigation

Our attorneys are experienced litigators who have prosecuted and/or defended cases throughout Southern California. We know from experience that many disputes, even those resolved amicably, require some type of court action, and that, while most cases that are filed in court are resolved by settlement it frequently takes court action to motivate the parties to reach a settlement.

While most real estate and family law cases are tried before the Court (i.e. a trial judge sitting without a jury), our attorneys also have substantial experience in jury trials for both plaintiffs and defendants. Our goal in litigation is to win, recognizing, however, that any true victory requires cost-controls and the exercise of judgment in order to attain our clients' most important objectives. To that end, we are experienced in litigating without the attendant acrimony which can increase the cost of litigation without enhancing the litigation's objective, focusing instead on achieving our clients' objectives in the most efficient, cost-effective and prompt manner possible.

Civil and Criminal Appeals

Excellent writing ability, precision research and strong advocacy skills are essential in appellate cases. At Hirschberg & Friedman, LLP, we have represented appellants and respondents in civil and criminal cases for over 30 years, including cases before the California Court of Appeals, California Supreme Court, Federal Appellate Courts for the Fifth, Seventh, Ninth and Tenth Circuits and in the U.S. Supreme Court. Our attorneys have successfully brought and defended civil appeals in real estate, family law, employment and administrative law cases, as well as criminal appeals in juvenile, dependency and cases including white-collar and internet crimes, drug convictions, sex-related offenses and violent crimes.
